Description

ESI Registration is a mandatory process for businesses in India under the Employee State Insurance Act of 1948, designed to provide social security and healthcare benefits to workers. The scheme applies to establishments with 10 or more employees (20 in some states), where workers earn up to INR 21,000 monthly (INR 25,000 for employees with disabilities). Employers must register their establishment with the Employee State Insurance Corporation (ESIC) to ensure their workers receive comprehensive medical and financial protection.

 

The registration process involves online submission through the official ESIC portal, where employers must provide detailed establishment and employee information. Employers need to gather necessary documents, complete the employer registration form, and upload supporting documentation. Upon successful verification, ESIC will generate a unique 17-digit code for the establishment, which is crucial for all future communications and transactions related to the insurance scheme.

 

Once registered, employers must enroll eligible employees on the ESIC portal, with each employee receiving a unique ESI number. Employees will be issued an ESI card that serves as proof of insurance and enables them to access various benefits including medical care, sickness benefits, maternity benefits, and disability support. The scheme requires monthly contributions from both employers and employees, creating a robust social security network that protects workers across various industries.

Who is eligible for ESI Registration?

According to the official notice, the following state government-affiliated entities fall under the scope of the ESI Act according to Section 1(5):

  • Retail outlets
  • Dining establishments or hotels solely involved in sales
  • Movie theatres, including preview facilities
  • Establishments related to road transportation
  • Newspaper organisations (exempt from the Factory Act)
  • Private healthcare facilities
  • Private educational institutions
  • Casual workers employed by Municipal Corporations or Bodies

These entities are required to register with the ESIC if they have a workforce of 10 or more individuals.

Furthermore, the Central Government has expanded the ESI Act’s Section 1(5) coverage to include the following central government-related entities:

  • Retail outlets
  • Hotels and dining establishments
  • Establishments related to road transportation
  • Cinemas, including preview theatres
  • Newspaper organisations
  • Businesses involved in:
  • Insurance
  • Non-Banking Financial Companies (NBFCs)
  • Port trusts
